PAYMENT IS DUE BEFORE END OF SCHEDULED PICK-UP DAYS/TIMESPlease look at your invoice for total if paid by cash/wire/cashier's check vs. credit cardBIDDERS WITH UNPAID INVOICES AT THE END OF PICK-UP, WHO DO NOT TAKE ACTION TO REACH OUT TO AUCTION COORDINATOR TO PAY THEIR OUTSTANDING INVOICE, WILL HAVE THEIR CARD ON FILE WITH PLATFORM CHARGED. IF THE CHARGE DOES NOT GO THROUGH, THEY WILL BE REPORTED. Items must be picked up during the specified pick-up dates and times. Items not picked up during the scheduled pick-up days/times will be subject to storage fees (amount determined by the auction house on a case-by-case basis). Items not picked up within 30 days of the auction close will be considered forfeited without a refund. Please contact the auction house PRIOR TO BIDDING for any special arrangements you may need. Only a written agreement with Auctioneer or Auction Coordinator can modify these provisions. Buying as is, where is with no contingencies, warranties, or returns of any kind. Buyer's premium on all transactions. No titled vehicle will leave the premises until funds clear. Not responsible for any lost, stolen, or misplaced items. Not responsible for any accidents. The buyer takes full responsibility for all items purchased. Although obtained from sources deemed reliable, the Auctioneer makes no warranties or guarantees as to the accuracy of the information herein contained. Bidders are encouraged to thoroughly inspect the items on which they intend to bid before sales. Absolutely no items will be removed until the auction is completed. Subject to additions, deletions, prior sale, and confirmation. A 25% cash deposit via wire transfer may be required if you are not known to the Auction Firm. Failure to make the required deposit may result in the cancellation of bidding privileges. Your invoice will be emailed to you after the auction. In default of payment of invoices in full within the stated time Buddy Barton Auctions and Auctioneer may retain all funds received as deposits as liquidated damages. Lots not paid for or removed within the time allowed may be resold at public or private sale without further notice. Any deficiencies and other expenses of resale will be charged to the defaulting purchaser. Some equipment must be removed by authorized riggers and contractors only. Riggers/Contractors must present Rosen/Barton with a valid commercial general liability insurance certificate in a minimum amount of $2,000,000.00 combined single limit per occurrence naming Buddy Barton Auctions as additional insured. Any hydraulic fluid removal and/or oil leaks are the winning bidder's responsibility to remove and clean up. The purchaser and/or rigger/contractor must take full responsibility for compliance with applicable environmental laws and exercise all reasonable care to ensure that there is no release to the environment or any hazardous wastes or substances as defined in applicable Federal, State, and Local Statues, Regulations, Rules, or Ordinances. When purchasing any machine that is hardwired or plumbed, the purchaser is entitled to the machine and applicable control panel (including, unless otherwise stated, the wiring between the panel and machine). Purchaser will not receive any additional electrical boxes, wiring, piping, breaker boxes, and/or junction boxes. All fluids must be drained and removed from the premises by the purchaser or designated rigging professional in an environmentally friendly fashion to create no hazard. All disconnections of equipment from utilities (unless otherwise noted) will be made by the purchaser at their sole expense and in accordance with all safety rules and regulations; this includes, but is not limited to: capping of electrical wiring, piping, filling in pits and closing of openings to the outside environment. At the auctioneer’s sole discretion, a financial deposit may be required to ensure that such disconnection from, and repairs to, the structure from which items are being removed are safe and that the premises are protected from damage or weather intrusion.
